Delhi HC Rules in Favour of IHCL in ‘Taj Iconic’ Case

‘Taj Iconic’ Barred from Using ‘Taj’ Name

The Delhi High Court has granted a permanent injunction to The Indian Hotels Company Ltd (IHCL) in a trademark suit against Taj Iconic Membership’s managing director. The court has prohibited using the “Taj” name in the contents, corporate name, and logo. Additionally, the court has ordered the transfer of Taj Iconic’s domain name to IHCL.

Justice Mini Pushkarna stated, “It is evident that the defendant, Taj Iconic, is using content and photographs from the plaintiff, IHCL’s website, for business activities. This action is misleading consumers and trade members, leading them to falsely believe that the defendant is directly connected or affiliated with the plaintiff.

Furthermore, the fraudulent and illegal trade activities of the defendant have caused incalculable harm and injury to the business, goodwill, and reputation associated with the plaintiff’s mark,” the High Court said while directing the managing director of Taj Iconic to pay damages amounting to INR 10 lakh and a cost of INR 5 lakh to IHCL, which is a part of the Tata group of companies.

The Taj Iconic has been found guilty of infringing the petitioner’s trademarks and photographs. Furthermore, it has been engaged in criminal activities by impersonating the petitioner and defrauding a jeweler of 100 gold coins worth Rs 51 lakh, according to the High Court. The court added that a party who chooses not to participate in court proceedings should not be allowed to enjoy the benefits of avoiding the legal process and must face the consequences of damages.
